Talk to Mathis, AI Coach Terms of Use

These Terms of Use (“Terms”) govern your use of the “Talk to Mathis” AI coaching tool (the “AI Coach”), a software tool provided by Dr. Mathis Kennington, PLLC (“I,” “me,” or “my”). They apply in addition to my Terms & Conditions of Use, Privacy Policy, Disclaimer, and AI Disclosure, each of which is incorporated by reference.

By entering your information and using the AI Coach, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the AI Coach.

You Are Talking to an AI, Not to Me

The AI Coach is an artificial intelligence tool. It generates responses using a language model that has been given instructions and information reflecting my coaching perspective and frameworks. You are not talking to Dr. Mathis Kennington personally, and you are not talking to a human being. The AI Coach speaks in the first person (“I”) to reflect my voice and approach, but every response is generated by software, not written by me in real time.

AI can be wrong, incomplete, or produce responses that do not fit your situation. Do not rely on it as a statement of fact or as professional advice. Use your own judgment.

Not Therapy, Not Professional Advice, Not an Emergency Service

The AI Coach is an educational and coaching tool. It is not therapy, not counseling, not medical, legal, or mental-health treatment, and not a substitute for care from a licensed professional. Using it does not create a therapist-client, coach-client, or professional relationship of any kind between you and me.

THE AI COACH IS NOT FOR EMERGENCIES. IF YOU ARE IN CRISIS, THINKING ABOUT HARMING YOURSELF OR OTHERS, OR IN AN UNSAFE SITUATION, STOP AND CONTACT EMERGENCY SERVICES, A LICENSED PROFESSIONAL, OR A CRISIS LINE IMMEDIATELY. IN THE UNITED STATES YOU CAN CALL OR TEXT 988 (SUICIDE AND CRISIS LIFELINE) OR CALL 911.

How Your Conversations Are Used

When you use the AI Coach, the questions and messages you type are collected and stored so the tool can respond and so I can improve it.

I also use these conversations, in de-identified and anonymized form (with names, contact details, and identifying specifics removed), to improve the AI Coach and to create educational content. This content may include a book, as well as articles, social media posts, videos, courses, and other materials published, distributed, or sold by Dr. Mathis Kennington, PLLC.

By using the AI Coach, you grant me a perpetual, worldwide, royalty-free, irrevocable license to use, store, reproduce, adapt, excerpt, and publish the content of your conversations in anonymized form for these purposes, without any obligation of payment or attribution to you. I will not publish your name or information that identifies you.

Please do not enter information that could identify you or another person (such as full names, addresses, phone numbers, employers, or other identifying details). Enter only what you are comfortable sharing on these terms.

Email and Communications

To use the AI Coach you provide your first name and email address. By doing so you agree to receive emails from me, including occasional educational and marketing emails. You can unsubscribe at any time using the link in any email. Your information is handled in accordance with my Privacy Policy.

No Use by Minors

The AI Coach is intended only for adults. You must be at least 18 years old to use it. Do not use the AI Coach if you are under 18.

No Guarantees or Outcomes

I make no promises or guarantees about any particular result, including saving, repairing, or changing any relationship or marriage. Your circumstances, choices, and the actions of others are outside my control. Any decisions you make based on the AI Coach are your own responsibility.

No Warranties

THE AI COACH IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE AI COACH WILL BE ACCURATE, RELIABLE, UNINTERRUPTED, OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DR. MATHIS KENNINGTON, PLLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE AI COACH, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR USE OF THE AI COACH IS AT YOUR OWN RISK.

Changes to the AI Coach and These Terms

I may change, suspend, or discontinue the AI Coach at any time, and I may update these Terms from time to time. Continued use after an update means you accept the updated Terms. The “last updated” date above shows when these Terms were last revised.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
